Please review these giveaway and contest (“G&C”) rules (“Rules”) before entering into G&Cs offered by Neil Goro and Michelle Goro p/k/a 2Gorostravel (“Influncer”). Notwithstanding anything to the contrary contained herein, each G&C, as applicable, is void where prohibited.
Eligibility: Unless otherwise stated in the instructions, terms, conditions, or other eligibility requirements contained on a specific G&C page: (i) no purchase is necessary to participate in or win a G&C; (ii) you may only enter into a G&C once using your email address/account/handle and numerous entries from a single email address/account/handle shall not be accepted and shall disqualify you; (iii) multiple entries by you from different address/account/handle are not permitted and shall disqualify you; and (iv) G&Cs are only eligible to legal United States residents of at least twenty-one (21) years of age at the time of submission. G&C entrants must send entries to Influencer using their correct email address/account /handle and any other information specified in the G&C description. You understand that any costs you incur in connection with entering a G&C shall be exclusively your responsibility.
Disqualification: Subject to Influencer’s sole discretion in each instance, all of the following occurrences, in any manner, shall disqualify you from a given G&C: (i) your submission of any incomplete or inaccurate information, or failing to complete all conditions set forth on a specific G&C page; (ii) violating the Terms, Rules, or any additional instruction, term, condition, or other eligibility requirement contained on a specific G&C page, including, without limitation, engaging in any fraud to undermine a G&C; (iii) being an employee or contractor of Influencer; (iv) being a family member of the owners of Influencer; (iv) tampering with the entry process, or any other process, of the G&C; (v) engaging in any offensive conduct related to the G&C; or (vi) Influencer failing to receive any necessary entry or information from you, regardless of how the transmission error occurred.
Selection Criteria: The specific winner selection criteria for a G&C will be stated on the G&C entrance page, however, if not otherwise stated, Influencer shall randomly select a winner from all G&C entries. Depending on applicable circumstance, odds of winning will depend upon the total number of eligible entries received. All closing dates and times are closed at the stated times in the G&C description, or otherwise at midnight, central time, on the closing date of the G&C.
Winner Notification: Upon winning an applicable G&C, Influencer, or its representatives, will notify the winner through the contact information provided. The individual receiving the winning notification at the contact information provided will be considered the winner of the G&C. Influencer will thereafter send the G&C prize to the location supplied by the winning recipient, provided that the winner provide Influencer with all requested information, which typically includes, without limitation, the winner’s legal name, mailing address, email address, birth date, phone number, and in the event of prizes valued over certain monetary thresholds, a W9 and other applicable tax form(s). The winner must claim the prize within thirty (30) days of Influencer sending the winner notification of winning the G&C, unless otherwise stated on a specific G&C page. In certain circumstances, failure to respond will result in forfeiture of the G&C prize. Influencer is not obligated to re-award any G&C prize(s) that are forfeited.
Name/Likeness: Without limiting anything in Influencer’s privacy policy located at www.2gorostravel.com, any information you submit as part of a G&C will be used for the purpose of administering the G&C. By entering into a G&C, you hereby consent and grant to Influencer, and Influencer’s affiliates, licensees, and designees, including, without limitation, any third-party partners Influencer is administering an applicable G&C with, in perpetuity, an irrevocable worldwide gratis license to use your name, likeness, and biographical materials, as well as any copyrighted material you submit in connection with a G&C, such as a photograph, for the purpose of administering the G&C and for Influencer’s (or such applicable partners) goodwill business advertising. For the avoidance of doubt, by entering into a G&C, you understand that anything you send to Influencer is not-confidential and Influencer may disclose your name and submitted materials as Influencer sees fit and as required by law.
Newsletters: Without limiting anything in the Terms, you acknowledge that Influencer, and any third-party partners Company is administering an applicable G&C with, may market to you about their business and other promotional opportunities (whether directly or indirectly), via your contact information submitted as part of a G&C, including, without limitation, your email address, as well as any information you add to your account. You may revoke consent to such activities by following “unsubscribe” information contained in such correspondences.
Prize: Winners may not request substitution of prizes. Unless otherwise stated on a specific G&C page, Influencer will be responsible for shipping any prize to you (however, Influencer will not be responsible for any lost shipments by a mail carrier). In the event a G&C prize becomes unavailable for any reason, Influencer may substitute the G&C prize with a similar or different prize of equal value. All prizes are awarded “as is” and Influencer makes no warranties or representations, whether expressed or implied, regarding the same. To the extent that the terms of a G&C contain an expiration date, in the event that you do not use or redeem any prize during the specified time frame, you will have been deemed to forfeit such prize.
Taxes: Winners are solely responsible for all taxes and/or fees that may be incurred in winning a G&C prize. Winners may forfeit any G&C prize prior to acceptance upon written notice to Influencer.
Representations and Warranties: Without limiting any representations or warranties in the Terms, by participating in a G&C, you warrant and represent that your entry is original, does not contain any material that violates the rights of any third party, including copyrights, trademarks, and rights of publicity and privacy, does not contain any defamatory of obscene material, and that upon the request of Influencer, you can provide all necessary clearances for any materials submitted to Influencer pursuant to a G&C. You additionally acknowledge and agree, in the event there is a dispute regarding a G&C, all such disputes shall be governed by the applicable dispute resolution terms and conditions contained in the Terms.
Indemnification: In addition to and without limiting any indemnification provisions in the Terms, each winner of a G&C agrees to indemnify Influencer, including its members, managers, directors, officers, employees, contractors, suppliers, vendors, affiliates, subsidiaries, successors, agents, attorneys, contractors and licensors against all claims, actions, suits, and other proceedings arising out of or incurred in connection with these Rules, including, without limitation, your usage of any G&C prize once you have been awarded and/or taken possession of such product or used such service.
Reservation of Rights: Influencer is not responsible for any errors in the administration or fulfillment of the G&C. All interpretations of these Rules and decisions by Influencer related to these Rules are determined in Influencer’s sole discretion and shall be final. Influencer reserves the right to cancel a G&C, and alter any rules of a G&C, at any time without any liability or obligation owed to you.
Requests: Some jurisdictions may require Influencer to make available to you written copies of the rules, the prize winner’s name (if applicable and the G&C prize is not forfeited), and other similar information. Requests received by individuals whose jurisdictions do not require Influencer to provide such information, or information received by Influencer thirty (30) days after the closing date of a G&C, may not be honored, subject to applicable jurisdictional laws.
